Payment Terms
Rhode Island Chocolate Fountain requires a 50% retainer in order
to reserve a Rhode Island Chocolate Fountain. To firmly hold your
reservation, return one signed and completed copy of the rental
agreement with the 50% deposit. The balance is due no later
than 14 days prior to the date of the event and can be paid in cash,
check or money order. All Checks should be made payable to Rhode
Island Chocolate Fountain. There will be a $35 fee charged for all
returned checks. We provide fountain use for all of RI, Southern
MA and Eastern CT. There will be a small, additional charge for
greater than 60 miles.
Cancellation
This agreement cannot be canceled, except in writing, by either
the Client or Rhode island Chocolate Fountains. If the Client initiates
the cancellation, Rhode Island Chocolate Fountains will refund ½
of the 50% deposit if the cancellation is within 60 days of the
event. If the cancellation is not within 60 days of the event, the
entire deposit is forfeited. In the event of extreme weather or
any other actions outside of the control of Rhode Island Chocolate
Fountain, whereby Rhode Island Chocolate Fountain cannot perform
the agreed to services, client's deposit shall be fully reimbursed.
Client will hold harmless Rhode Island Chocolate Fountains in the
event of illness, injury, act of God, or any other situation beyond
control of Rhode Island Chocolate Fountains that prevents Rhode
Island Chocolate Fountain from performing.
Provisions
Rhode Island Chocolate Fountain requires access to the desired setup
area at least 1 hour prior to the scheduled start time. In addition,
20 minutes are required after the conclusion of the service period
for take down and removal (this time does not count toward the 4
hours of fountain service time). The Client is responsible for providing
a sturdy, level table capable of supporting at least 150 lbs. Client
is also responsible for providing two table linens that coordinate
with their color scheme. Rhode Island Chocolate Fountain requires
at least one - 110 volt circuit within 10 feet of the desired setup
area that adheres to contemporary safety standards and supplies
at least 15 amps. Once the Chocolate Fountain has been set up in
the desired location, it cannot be moved during the event. Client
accepts full responsibility and is liable for any damages, injuries
or delays that occur as a result of failure to comply with these
provisions. Rhode Island Chocolate Fountain reserves the right to
use any picture(s) from the event in advertising.
Liability
This Agreement and the contents hereof represent the only warranties,
express or implied, between the parties, including any implied warranty
of merchantability or fitness for the particular purpose and for
any other obligation or liability on the part of the Rhode Island
Chocolate Fountain. Rhode Island Chocolate Fountain shall not be
liable for any injury, loss or damage directly or consequently arising
out of the use or inability to use the Chocolate Fountain, whether
used singularly or in conjunction with any other equipment. In the
event of litigation all parties agree to mediation first. Any litigation
will be restricted to the county of Providence, in the state of
Rhode Island. Client will indemnify Rhode island Chocolate Fountain
against, and hold Rhode Island Chocolate Fountain harmless from
all claims, actions, proceedings, costs, damages and liabilities,
including attorney fees, arising out of, connected with, or resulting
from the use of the Rhode Island Chocolate Fountain.
Rental Agreement
A Rental Agreement needs to be signed and
submitted with a 50% deposit to firmly hold your fountain reservation.
